Changes to ISED Regulations Canada

The authority for certification and approval of radio and telecommunication products in Canada  (Innovation, Science and Economic Development Canada – ISED), is changing its requirements for wireless device testing.

After March 15, 2019, ISED will only accept test reports from ISED accredited testing laboratories.

After this deadline all ISED certification bodies can only use test reports of ISED accredited laboratories for certifications of radio equipment in Canada.

“After an audit by the national accreditation body of Germany (DAkkS) at the beginning of December, 7layers is now officially listed as an accredited testing laboratory at ISED” explains Marco Kullik Manager Radio and EMC at 7layers “and we look forward to providing our customers further on with ISED approval services for Canada such as measurement and tests for ISED certification, taking over the entire certification process and coordination with authorities.”

Indonesia – New Type Approval Regulations

The Indonesian radio and telecommunication regulatory authority (SDPPI) published 2 new regulations pertaining to type approval—PM Kominfo Nomor 7 Tahun 2018 and PM Kominfo Nomor 16 Tahun 2018.   The most significant changes include new requirements for the applicant (local representative) and updated labelling requirements.

Applicant / Local

Representative for foreign manufacturers, the applicant must now be the real importer or actual distributor legally registered in Indonesia. The Memorandum of Understanding (MoU) between the manufacturer and the distributor has to be submitted along with the other required application documents.

Labelling Requirements

The existing label must now be accompanied with the QR code which can be found on every certificate. For products other than short range devices, a warning sign must also be affixed to the device. The certificate holder has to provide a photo of the actual label on the device to the authority within 30 working days after the type certificate has been issued

Devices need national approval in Pakistan after removal from exemption list.

Due to changed regulation by the PAKISTAN TELECOMMUNICATION AUTHORITY (PTA), from 19th DEC 2018, some types of devices were removed from exemption list.

As you can see in the extracts below, devices of category 6, 7 and 8 were removed. Sorry for bad quality but even the reference on authority’s webpage shows no better resolution.

The Action Plan for Promoting the Scale Deployment of the Internet Protocol Version 6 (IPv6) was issued by the General Office of the CPC Central Committee and the General Office of the State Council on November 26, 2017. The Outline of the Thirteenth Five-Year Plan for National Economic and Social Development, the Outline of the National Informatization Development Strategy, and the National Informationization Plan for the Thirteenth Five-Year Plan, develop this action plan. All network products used in China mainland, including mobile phones, terminals, switches, fax machines, videoconferencing and so on, should support IPv6 as long as they support IP protocol. After Dec. 01, 2018, the network products which get NAL/MII (Ministry of Industry and Information) approval must need support IPv6. Network operators also require terminals to support both IPv4 and IPv6 from Oct. 01, 2018. For the devices(without IPv6) which already get NAL/MII approval before Dec. 01, 2018 and the certificates are still in valid, customer can update to IPv6 via software by themselves, after certificates become invalid, customer can make new NAL/MII application to add IPv6.

Transitional period for updated FCC authorization program expired in November

For one year, the updated authorization program for FCC certifications for devices with radio technologies to be approved on the U.S. market was undergoing a transition period. Since November 2018, the sDoc procedure has been applicable for new devices and for changes made to devices after November 2, 2018, with self-declaration. The certification procedure by accredited test laboratories such as 7layers remains unchanged. Since no certificates are issued in the case of self-declaration, the involvement of an official certification body is not necessary and FCC self-decalination is a very convenient procedure. But However, the following must be observed for the sDoc procedure:

  • SDoc is only possible for “Unintentional Radiator*” and not for all device types.
  • A local representative in the USA is mandatory.
  • The devices must comply with the corresponding FCC standards.
  • Different company or quality guidelines can lead to different interpretations of the applicable regulations and standards.
  • The legal responsibility for the correctness of the statements lies with the manufacturer or the person who places the product on the market.

Update of type approval regulations in Ukraine – transition to RED in force from 1 April 2019

Due to new regulations in Ukraine and the transition to the RED regulations, according to the decision of the National Commission for Communications Regulation of Ukraine No. 117 and the The Technical Regulation of Radio Equipment, Decree of the Cabinet of Ministers of Ukraine No. 355, the certification procedure will be slightly changed. To comply with them from April 1st 2019, it is necessary to obtain a “TYPE EXAMINATION CERTIFICATE” as an approval for usage of RF units.

In order to summarize the most important changes for the type approval process, we provide answers to six FAQs below:

Question 1: Aside from the Type Examination Certificate, are there any documents needed to prove compliance to the new regulations?

Beginning April 1st, a local representative needs to issue a Declaration of Conformity (DoC) in Ukrainian language, based on the Ukrainian national test reports. If a third party is required to serve as local representative, 7layers can offer optional assistance.

The Ukrainian DoC is equivalent to the DoC in accordance to RED in Europe, regulations concerning these documents are almost the same. Main idea of this document is to declare technical compliance to Ukrainian requirements (which are now very similar to the RED requirements).

Question 2: Will Type Examination Certificates be issued with limited validity?

There is no limitation for Type Examination Certificates released under the new rules.

 

Question 3: When will the new regulations in Ukraine come into full force?

New rules were released in December 2017 and will come into force from April 1st 2019.  The time period between April 1st 2018 and April 1st 2019 is considered a transition period.

Beginning in early April 2018 the authorities and laboratories in Ukraine started to release the majority of test reports, certificates and DoCs according to the new regulations. However, in specific cases during the transition period, the Certification Assessment Bodies (CAB) still based their approval results on the regulations before April 2018.

Question 4: How do I know if my approval result complies with the new regulations?

For your valid approvals a renewal process has to be initiated to be in compliance to the The Technical Regulation of Radio Equipment,  Decree of the Cabinet of Ministers of Ukraine No. 355. For all approval results issued between April 1st 2018 and March 31st 2019 compliancy to the reworked Ukrainian regulations should be checked. If compliancy to the The Technical Regulation of Radio Equipment, Decree of the Cabinet of Ministers of Ukraine No. 355 and to RED standards is explicitly mentioned in “Type Examination Certificate” and related DoC  , your approval result already complies with the new requirements and no update will be required.

 

Question 5: What are the additional requirements (aside RED requirements) for the approval process under the new regulations?

  • The DoC (Ukrainian, in full or short form) or a reference to it, e.g. as weblink, must be part of the user manual. During the transition period until April 1st 2019, it is sufficient for the approval process to submit a declaration stating that this user manual will be available as soon as the product will be placed on the market.
  • The user manual must be provided in national language. Beside common values (manufacturer name, address, model-name), operation frequency range and max. power output power must be mentioned in national language as well as a local contact of the national warranty service provider.
  • The CE risk assessment in Ukrainian language is part of the compliancy documentation.
  • In case a device meets certain criteria specified by the frequency management authority NKRZI, manufacturer and local representative have to be entered into the authorities national register. Of the equipment in our range of activities, only radar devices need this registration.*
  • For EU-based companies: PoA from manufacturer to local representative, signed by person authorized in business license (if signed by other person, apostil needed) is mandatory.
  • For Non-EU-based companies: PoA from manufacturer to local representative with apostil will be mandatory.

Question 6: Will there be changes regarding labeling of the product?

– The CAB-no. is not part of the labeling anymore, just the national logo is mandatory.

– The NKRZI registration code must be indicated on the on product/package/user manual.
